Police arrested Tara for a bank robbery and brought her to an interview room. A detective intentionally did not give Miranda warnings because, as he later wrote in a training memo, "It is easier to get the first admission before the warnings." The detective questioned Tara for 40 minutes. He did not threaten her or promise leniency. Tara admitted that she hid the cash in a storage locker and gave the locker number. Police immediately found the cash there.
After a 15-minute break in the same room, the same detective read Miranda warnings for the first time. Tara signed a waiver and repeated the confession on video. The detective did not tell her that her earlier unwarned answers might be inadmissible. At trial, prosecutors want to use the locker cash, the warned video confession, and, if Tara testifies that she was never at the bank, the first unwarned admission to impeach her.
